DMCA / Copyright Policy

COLMEKX.VIP respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond expeditiously to claims of copyright infringement committed on our site.

1. Notice Requirements

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the site by submitting a written notice. Your notice must include the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, including the exact URL(s) of the pages containing the material;
  4. Your contact details, including your physical address, telephone number, and email address;
  5. A statement by you that you have a good-faith belief that the disputed use of the material is not authorized by the copyright owner, its agent, or the law;
  6. A statement by you, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

2. Counter-Notice Process

If you receive a notification that your content has been removed due to a copyright infringement claim and you believe this was done by mistake or misidentification, you may submit a counter-notification. The counter-notification must contain:

  • Your physical or electronic signature;
  • Identification of the material that has been removed and the URL location prior to removal;
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is outside the United States, for any judicial district in which the service provider may be found, and that you will accept service of process from the person who provided the original infringement notification.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, COLMEKX.VIP has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, access to users, account holders, or content providers who are deemed to be repeat infringers.
